PUBLIC NOTICE

 

At a special meeting of the Town Board for the Town of Volney held the 5th day of May, 2026 at Volney Town Hall, 1445 County Route 6, Town of Volney, County of Oswego, State of New York at 6:00 p.m. the following resolution for Public Hearing was adopted.

 

RESOLUTION/ORDER FOR PUBLIC HEARING TO INCREASE THE MAXIMUM AMOUNT TO BE EXPENDED FOR THE CONSTRUCTION OF THE COUNTY ROUTE 6 – MAPLE AVENUE WATER SERVICE AREA IN THE TOWN OF VOLNEY PURSUANT TO ARTICLE 12-A, SECTION 209-d OF THE TOWN LAW OF THE STATE OF NEW YORK

 

            WHEREAS, at a regular meeting of the Town Board for the Town of Volney held the 21st day of April, 2021, the Volney Town Board duly adopted a Resolution authorizing C2AE, Consulting Engineers of 70 Main Street, Canton, New York 13617, to prepare a Map, Plan and Report for the possible establishment of the County Route 6-Maple Avenue Water Service Area within the Town of Volney, said map, plan and report to include the installation of water lines and other necessary improvements to establish a water distribution system; and

 

            WHEREAS, by said Resolution, the Town Board believed it in the best interest of the citizens of the Town to expand the water system, said proposed water system expansion which includes portions of State Route 3, County Route 6, County Route 9, Bock Road, Maple Avenue and Silk Road in the Town of Volney; and

 

            WHEREAS, said Map, Plan and Report was filed with the Town Clerk for the Town of Volney on the 21st day of April, 2021, entitled Town of Volney Map, Plan, and Report for County Route 6 – Maple Avenue Water Service Area dated April 2021; and

 

            WHEREAS, the Board has reviewed the Map, Plan, and Report, and held a Public Hearing on May 16, 2024, at 6:00 p.m. and continued on June 18, 2024, at 6:00 p.m., regarding the possible formation of a water distribution system expansion to be known as the County Route 6 – Maple Avenue Water Service Area pursuant to Article 12-A Section 209-d of the Town Law of the State of New York; and

 

            WHEREAS, the improvements proposed are a new water distribution expansion system which will connect to the Town’s existing water systems to include meter pits, remote read meters and service lines to the curb box.  Fire hydrants will also be installed as part of the project; and

 

            WHEREAS, the Town being advised that the price of steel has resulted in additional expense to be incurred in the construction of the said water district; and

 

            WHEREAS, the maximum amount proposed to be expended for such improvements has increased to NINE MILLION DOLLARS ($9,000,000.00), and the additional cost will be addressed with grant funding and not an increase of loan/debt funding; and

 

WHEREAS, the proposed methods to be employed for financing such system are Federal funding options.  In addition to the original FY2021 USDA-RD grant of ONE MILLION FIVE HUNDRED THOUSAND DOLLARS ($1,500,000.00), and a loan of TWO MILLION TWO HUNDRED FOURTEEN THOUSAND DOLLARS ($2,214,000.00), the Town has successfully applied for and received the following supplemental grant awards:  (1) FY2022 STAG Grant: TWO HUNDRED EIGHTY THOUSAND DOLLARS ($280,000.00); (2) FY2025 CDBG Grant: TWO MILLION DOLLARS ($2,000,000.00); and (3) FY2025 WIIA Grant: FOUR MILLION FIVE HUNDRED TWENTY-FIVE THOUSAND NINE HUNDRED FORTY-THREE DOLLARS ($4,525,943.00); and

 

            WHEREAS, The estimated annual cost to the typical property/typical home or equivalent dwelling unit (“EDU”) would be $1,017.00, said amount includes the typical annual water use costs estimated at 150 gallons per day; and said annual cost would be assessed solely against properties in the proposed water service area on a benefit basis according to the established “EDU” criteria; and

 

            WHEREAS, a Map, Plan and Report describing such improvements are on file in the Office of the Town Clerk of the Town of Volney for public inspection; and it is further

 

            ORDERED, the Town Board of the Town of Volney shall hold a Public Hearing pursuant to Section 209-h of the Town Law of the State of New York to consider the increase of the maximum amount to be expended for the formation of the County Route 6 – Maple Avenue Water Service Area with the improvements specified above, said hearing to be held the 21st day of May, 2026, at 6:00 p.m. at the Volney Town Hall, 1445 County Route 6, Fulton, New York, at which time and place all persons interested in the subject thereof may be heard concerning same; and

 

            ORDERED, that the Town Clerk of the Town of Volney is hereby authorized and directed to publish a copy of this Resolution/Order in the Palladium Times, the official newspaper for the Town of Volney, and post a copy of same on the sign board of the Town of Volney in the time and manner required by law.
